In these Terms and Conditions “Emerald Heritage”, “we”, “us”, “our” or “EH” refer to Emerald Heritage Limited, the owner of this (www.emerald-heritage.com) website, trading as Emerald Heritage, and “you”, “your” or “the Buyer”) refer to you, the user of this web site.

When you access this EH website you are deemed to accept these terms and conditions. If you do not agree to this condition you should leave this website immediately.

By submitting an order for EH goods, you are deemed to accept these terms and conditions. You should read our terms of sale carefully before placing an order and retain a copy for your future reference.

When you register with our website, you are required to choose a contact email address and password. You are responsible for all sessions and transactions taken under these details. Keep your password safe and do not disclose it to anyone. Please change it immediately if you are ever suspicious that it has become compromised.

It is important to point out that we do not sell personal titles. We only sell equitable interests in land. This is a very important distinction. An interest in to land is quite different from a personal title. It means an “entitlement” to the interest in the land. land. Once you have purchased your equitable interest in the land you can, however, avail yourself of an honorary purely descriptive title, such as “Squire”, which in the past meant an owner of land in Ireland. Today titles such as “Squire” or “Esquire” usually have no connection with land, such as U.S. attorneys using the suffix “Esquire” (Esq.). Note that due to a change of government policy, since 2017 we only sell equitable interests in land not title to the land.

A person who is under the age of 18 should only use this web site with the supervision and permission of an adult, who takes full contractual responsibility for any actions taken by the minor.

You must ensure that your information is accurate and up-to-date.

EH or you may terminate your account at any time. Should we decide to terminate your account, we shall notify you by email with an explanation for the termination. However, we reserve the right to terminate your account without giving any reason.

If we terminate your account, any pending or current purchases on your account will be cancelled and not dispatched. We reserve the right to cancel a purchase without explanation. If we cancel your purchase, you will be refunded all funds paid in relation to the purchase.

We reserve the right to amend our prices and remove any special offers from the website at any time. All our pricing structures are reviewed from time to time.

When you place an order on our website, this constitutes an ‘Offer to Buy’ from you. Unless we see reason to the contrary, we will accept your order by sending you confirmation by email. This acceptance will be deemed to complete the purchase. This acceptance by email constitutes a legally binding contract between you and us. Any term sought by you in your order which is contrary to these terms and conditions will not be part of the contract.

Our website is updated very regularly with regard to stock availability. While we make every effort to show the correct available stock, the stock availability shown on the website is merely an indication of the availability at the time of the last update and does not constitute confirmation of stock availability at time of order. We are entitled to withdraw from any contract that cannot be fulfilled due to the lack of stock. If a stock availability issue is discovered with regard to the goods that you have ordered before the contract is made, we will contact you as soon as is possible by email.

We try to ensure that all goods shown on the website are accurately represented, but please note there may be slight variations. All graphic descriptions, drawings and specifications on our website or by advertising are to give an approximate idea of the goods we are supplying. This does not form part of our contract and is not a sale by sample.

When visiting the land, we ask owners of equitable interests in the plots to respect the boundaries with neighbouring land owners and not to stray into the adjacent land.

The land is strictly for conservation purposes at sole discretion of Emerald Heritage.

Your user-name and password on our website is for your single use only and we do not permit multiple users to use one’s personal user-name and password.

Should you decide to use our communication facilities, you agree to do so in accordance with the following:

1. You must not use any offensive, abusive, threatening, harassing, defamatory, obscene, sexist or racist language. Neither can you submit any content that is intended to promote violence.
2. You must not imply that you are another person, other than yourself. This includes purporting to be any of the Emerald Heritage Limited employees. All the information that you submit must be honest, accurate and truthful.
3. We cannot respond to emails or enquiries received in any language other than English.

Although there may be other links to our website from other websites, this is for your convenience only. We are not responsible for any content on other websites. We do not represent them in any way whatsoever. Any access you make to these linked websites is entirely at your own risk.

If you wish to create a link to our website you must receive written authorisation from us to do so. If you have received or purchased a voucher from us or any other website, please note – it is strictly one voucher per order/transaction.

Emerald Heritage Limited or any other party associated with the company excludes all liability and responsibility for any loss or damage that occurs in connection with your dealings with us. This includes consequential loss or damage in any way connected with our website or the material on our website, included but not limited to loss of damage due to viruses in your computer, equipment or software because of access to our website or links to our website.

We shall not be liable to you for any economic loss, loss of profit, loss of business or depletion of goodwill or otherwise, in connection of any claims for direct or consequential compensation whatsoever (howsoever caused) which arise in connection with our dealings with you.

Weather/Acts of God, Strikes, Equipment failure, Host equipment failure, Communications network failure, Power failure, Acts of war or legal restrictions and censorship.

All responsibility for interests of ownership and risk of loss and/or damage in the goods purchased shall pass to you at the point and time at which the goods are dispatched or, if later, charged to your card or account. Any sale takes place in Alderney and is completed in Alderney.

All intellectual property rights in this website are owned by us and any use of this website or its contents including copying other than for your own personal and non-commercial use is prohibited without our prior written consent.

You are not permitted to copy, reuse or resell any of our trademarks, design marks or copyrights, unless authorised in writing by one of the Emerald Heritage directors. This includes but is not limited to graphics, logos, images, data compilations, page layout, software, text, icons, sounds clips, video clips. It is unlawful to copy or print any extracts from this website. All intellectual property rights on this website are owned by Emerald Heritage Limited.

Emerald Heritage Limited has no liability for any damage or defect caused by any event or circumstance beyond our control. These terms and conditions, together with our web site prices, delivery details and contact details set out the whole agreement relating to the supply of the goods to you by us. These terms and conditions cannot be varied except in writing signed by a Director of Emerald Heritage Limited. In particular anything said by any members of our sales staff which varies from these terms and conditions will not be accepted as a valid variation unless confirmed in writing by a Director as a valid variation. Emerald Heritage Limited shall have no liability for any such representation whether true or misleading.

Should we not receive any communication from you within 10 working days of your order being dispatched, we shall presume that you have received your order with no faults and that you are happy with the goods.

If on receipt of our written response you still consider your complaint has not been adequately addressed you can write to the Directors of Emerald Heritage Limited, detailing the informal and formal efforts to resolve the problem. This must be submitted no later than 10 working days from the date of the decision which you consider unsatisfactory. The Board will review your complaints and seek to reach an amicable conclusion and notify you within 10 days.

The contract between us shall be governed by and interpreted in accordance with the Laws of the island of Alderney, Channel Islands, and the Alderney courts shall have jurisdiction to resolve any disputes between us.
